STANDARD TERMS OF SALE

Midwest Parts and Service, Inc. (MPS) warrant all its products supplied by Tong Myung Heavy Industries CO, LTD to be free from defects in material and workmanship for a period of (18) months from date of shipment, (12) months from date placed in service, or 1500 hours whichever occurs first .. EXCEPT AS SET FORTH HEREIN, MPS, INC. MAKES NO OTHER WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

MPS, Inc. warranty shall be limited to repair or exchange, FOB shipping point. MPS, Inc. may request the buyer to make units available for inspection by MPS, Inc. personnel, at a place designated by Midwest Parts and Service, Inc.

Units repaired under warranty and returned to buyer shall be warranted for the remainder of the original warranty period. Units exchanged shall be warranted for a new warranty period.

The above expressed warranty does not cover conditions over which MPS, Inc. has no control, including; no allowance shall be made for consequential damages or any labor charges of buyer for replacement of parts, adjustments or repairs, or any other work and time or travel, and are not limited to, foreign materials in the fluid system, pressure and speed in excess of published recommendations, product damaged, subject to accident, abuse after shipment,

Products altered or repaired by other than MPS, Inc. or an authorized service center.

All Midwest Parts and Service, Inc. remanufactured pumps and motors (Reman Units) will be remand using OEM parts only and will Carry a warranty of 12 months from date of shipment or 1000 hour of placed into service usage, whichever occurs first.

All after market parts (None Tong Myung Heavy Industries Co. L TD made) will carry a 6 month from date of shipment or 500 hour of placed into service usage, whichever occurs first.

The buyer has a maximum of 30 days to return all unused and unopened products for credit, and a restocking charge of 20% will be applied to all returned products.

All sales are net 30 days of invoice date. All invoices over 40 days will be charged a late fee of 1.5% for each 10 days over 30 days there after. Do to the cost of instituting an invoice a minimum order of $25.00 applies to all new purchase orders, the above is with no exceptions.
